PRELIMINARY REPORT ON THE PROGRESS OF THE GENERAL ELECTIONS PROCESS OF JULY 3, 2005 IN ALBANIA

 

   

ARBITRARY BEHAVIOR OF THE HEAD OF DEPARTMENT

OF THE STRUGGLE AGAINST CRIMINALITY

 

 

In response to a complaint of two citizens Z. Hajdari and S. Kumrija, former policemen of the police in Berat, arguing that they have been maltreated by the head of the department struggle against criminality of the local police commissariat A. Hasani, the AHC verified the case on the ground and came to the following conclusions:

 

  1. On March 8, 2002 the head of the department has detained illegally without the relevant request of the prosecutor, the two above mentioned persons, accused for having committed a penal offence. In fact, the prosecutor had closed their case, while the court had ordered their return to their job.

  2. The head of the department, in presence of other officials of police, had maltreated the two former policemen and, as a result, they were seriously damaged. The prosecutor of the district ordered their immediate release and brought the case before the court accusing the head of department as offender of the law.

 

The AHC has more than once denounced similar arbitrary acts, which are at the damage of the reputation of the forces of public order. Regretfully, these cases of violation of the law by police forces continue to be rather frequent. It is a problem of serious concern and the AHC suggests to the competent organs to bring before justice all those responsible for violation of the law whatever their position. This would show the serious engagement of the police to respect the law in all circumstances.
