Legal critique for improving the
justice system for juveniles
The Albanian Helsinki
Committee (AHC), during January, engaged in providing legal critique on draft
acts of legislation for juveniles. In this framework, the AHC gave its
recommendations with regard to various legal aspects of the draft proposal for
juvenile legislation.
The AHC placed more emphasis on issues of the substantial
(penal) law, the procedure law, and measures that the state should undertake in
the future in order to implement legal provisions in practice.
Among the most important issues that the AHC addressed were:
the rejection to increase the age limit for penal responsibility, the need to
establish a section that adjudicates juveniles, alternative punishments for
juveniles, medical and educational measures, infrastructure in detention
facilities and prisons, specialization of judges and other judicial bodies, etc.
The AHC presented the conclusions of the legal critique of the
package proposed by experts also at a round table organized in conjunction with
the Justice Ministry and UNICEF. |
