THE KEEPING OF PERSONS SENTENCED BY A FINAL COURT DECISION, IN DETENTION SHOULD BE BROUGHT TO AN END

 

 

The correspondent of the Albanian Helsinki Committee notified that two days ago, in the premises of the Elbasan police station, part of the people being kept in detention rooms of the police station initiated a protest. They are mainly persons sentenced through a final court decision.

 

According to our correspondent, they request their transfer to institutions where they can serve their sentences. According to on-site verifications and conversations with the Director of the District Polic, the head of public order, the person responsible for detention facilities, it results that the Elbasan police station, although it has a capacity for 45 persons, it is in fact hosting 80 persons. The situation becomes even more difficult in those facilities, considering that the hot weather is approaching. During the observation, it was found that out of the 80 persons in that facility, 16 of them have been sentenced through a final court decision.

 

The Elbasan District police Directory has sent two letters to the General Directory of Prisons asking for the transfer of those sentenced through final court decisions.

 

The Albanian Helsinki Committee has raised several times the immediate need to transfer all those sentenced through a final court decision to the institutions where their terms can be served. However, it appears that in spite of undertaken measures, the above issue still remains problematic. That is the reason why the AHC considers it necessary to address the Ministry of Justice and the General Director of Prisons once again on this issue. It is clear to all that keeping individuals sentenced through a final court decision in detention facilities is a violation of the law and it may be accompanied by harmful concerns and consequences.

 

On this occasion, the Albanian Helsinki Committee suggests to the Ministry of Justice, for transparency reasons, to take the above issue into consideration by determining the respective deadlines that would provide for a resolution of this situation.
