PRELIMINARY REPORT ON THE PROGRESS OF THE GENERAL ELECTIONS PROCESS OF JULY 3, 2005 IN ALBANIA

 

 

 

Project Improvement of the human rights situation through monitoring, study, lobbying, and protection of human rights for better respect of constitutional principles
Implementation period: November 2003 – April 2005
Funded by: Swedish Helsinki Committee

 

Goal of the project: Contribute to respect for the rule of law by improving laws and the practice of their implementation.

 

Concrete project objectives:

  • Improvement of legislation in areas such as the electoral system, free legal aid, and improvement of the justice system for juveniles;

  • Monitoring enforcement of Albanian legislation in the electoral system, free legal aid, and penal justice for juveniles;

  • Enhancement of lobbying activities for respect for the citizens’ political rights and freedomds.

Activities carried out in the context of the project

 

  1. Three studies on the Electoral Code, free legal aid in penal processes, and penal legislation for juveniles;

  2. Survey of 350 arrested and convicted persons, 60 lawyers, 47 justices and prosecutors on the implementation of the right to defense in penal processes;

  3. Development of a round table discussion on free legal aid in Albania;

  4. Preparation of a publication on free legal aid;

  5. Meetings with representatives of state institutions and civil society actors active in this field;

  6. Frequent monitoring in penitentiary institutions and detention institutions;

  7. Addressing denounced violations in the above areas;

  8. Publication of a study “Electoral reform.”

Project Results:

 

  • Relevant state activities were sensitized on problems of the law and its enforcement;

  • Legal initiatives undertaken by responsible institutions in the area of electoral reform, reform in the penal justice system for juveniles, and free legal aid.

  • Many of the violated rights found in the above areas were reinstated.

The Albanian Helsinki Committee assures the anonimousity until the moment when the person desires to publish his data
