“Ndalimi i torturës”

 Gjatë këtij tremujori është botuar një broshurë për ndalimin e torturës përpunuar nga Prof. Arben Puto. Broshura ka si objekt zbërthimin e instrumentave ndërkombëtare të kësaj fushe si “Konventa kundër torurës, dënimeve ose trajtimeve të tjera mizore, çnjerëzore dhe poshtëruese”, e miratuar nga OKB në vitin 1984  dhe “Konventa Evropiane për parandalimin e torturës dhe trajtimit ose dënimit çnjerëzor”, e miratuar nga Këshilli i Evropës më 1987.

Materiali është ndarë në disa kapituj sipas rëndësisë së tyre. Këta janë: Nocioni i Torturës, Mekanizmat e vëzhgimit, Tortura dhe format e tjera të keqtrajtimit, si dhe Legjislacioni i brendshëm, ku çështja trajtohet edhe në një plan krahasues me legjislacionin shqiptar të kësaj fushe. Një tjetër kapitull është edhe ai i titulluar Detyrimi i shteteve palë për të hetuar rastet e përdorimit të torturës dhe për të përcaktuar përgjegjësitë përkatëse.

Materiali mbyllet me trajtimin e çështjes së trajnimit dhe edukimit të personelit përkatës, si kusht për njohjen dhe zbatimin e dispozitave qoftë të instrumentave ndërkombëtare, qoftë të akteve ligjore të brendshme.

“Prohibition of Torture”

 During this period a brochure on prohibition of torture was published. Its purpose is the explanation of the relevant international instruments, as “Convention against torture, punishment and cruel, inhuman and degrading treatment”, approved by the UN in 1984 and “European Convention on prevention of torture and inhuman or degrading punishment” approved by the Council of Europe in 1987.

The brochure is divided in some chapters according to their importance. The chapters are as follows: The notion of torture, the mechanism of control, torture and other forms of maltreatment and the national legislation. The question is dealt with in a comparative approach to the Albanian legislation on this mater. A second chapter is that concerning the obligation of States parties to investigate the cases of use of torture and to identify the respective responsibilities. The booklet is dealing with the question of training and education of the staff of this field, as a precondition for the information and the implementation of the provisions of the international instruments and internal law as well.
